Making the Decision to Declare or Not To Declare Bankruptcy

By Gregory & Clark  May. 9, 2011 10:46a

Not only in Florida, but in many states around the country, more and more people are having financial difficulties and are looking for immediate and effective solutions to their problems. In 2005, reforms were passed by Congress that affected bankruptcy around the nation and new rules were put in place by the Bankruptcy Abuse Prevention and Consumer Protection Act.

Debtors now must prove they are eligible for declaring bankruptcy. They must take what is called the "Means Test" to determine if they qualify for a Chapter 7 bankruptcy, and if not, they may have to file for a  Chapter 13. Bankruptcy is not the only option; it could be that you need a loan modification, a short sale or another possible solution instead of declaring bankruptcy.
