  Will Bankruptcy Permanently Ruin My Credit?

Are you inundated with mounting debt?  Are you struggling to find ways to repay your creditors? 

If you are one of the millions of Americans with mounting unpaid debt, bankruptcy may be a viable option for you.  While millions of people have taken advantage of U.S bankruptcy laws, many people struggling with insurmountable debt are holding back, afraid a bankruptcy filing will permanently destroy their credit and financial future.

If you are considering filing for bankruptcy, but are worried how the filing will affect your future, you may be surprised to learn to that a bankruptcy will not stay on your credit history forever, and that you'll soon be able to start rebuilding your credit.

In general, a bankruptcy filing will remain on your credit history for 10 years.  But despite having a bankruptcy on your creditor report, you can start re-earning credit shortly after your bankruptcy petition is processed.  Although you may experience a higher interest rate and smaller credits limits, you will nonetheless still be able to obtain credit.

While rebuilding your credit it is important to keep several things in mind to ensure your debt doesn't spiral back out of control:

1. Don't spend more money than you can afford to pay off

2. Make each of your payments on time and in full

3. Don't open more lines of credit than you can reasonably manage to pay off

5. Keep track of how much you are spending each month, and where your money is going.  This will help you look for areas where you can cut back on spending.

6. Try to save more money.  By having some money in a savings account, you will be prepared in the event of an unexpected emergency, sudden job loss, sudden illness, etc.

  Massachusetts Sees an Increase in Chapter 7 Bankruptcy Filings

According to a recent report from The Warren Group, Chapter 7 bankruptcy filings in Massachusetts have increased 58 percent in the second quarter of 2009 from the same months in 2008.

The report stated that a total of 4,489 people sought Chapter 7 bankruptcy protection from April to June, which is 2,839 more people who sought Chapter 7 bankruptcy during the same months in 2008.  In fact, the second quarter filings were higher than each of the previous five quarters.  There were more than 7,000 bankruptcy filings in the first half of 2009, whereas last year there were only 5,722 filings.

The number of bankruptcy filings during the first quarter of 2009 was also 36.6 percent higher, with 3,285 people filing for bankruptcy protection under Chapter 7.

Timothy M. Warren, Jr., CEO of The Warren Group, attributes the surge in bankruptcy filings to the poor economy, and the fact that many people aren't able to keep up with their bills as a result.

Chapter 7 bankruptcy is by far the most commonly sought after type of consumer bankruptcy, as a debtor can eliminate the majority of his or her debts by liquidating his or her non-exempt assets to repay creditors.

According to The Warren Group's findings, 82 percent of the bankruptcy filings in Massachusetts during the second quarter were under Chapter 7.

  Chicago Cubs Owner May File for Chapter 11 Bankruptcy

In an effort to expedite the sale of the Chicago Cubs, the owner of the team may file for Chapter 11 bankruptcy.

Tribune Co., which filed for bankruptcy in December, said it may consider a separate bankruptcy filing for the team as a way to clear the team from any future liability in the Tribune bankruptcy.

Tribune is currently in talks with the Ricketts family to sell the team for an estimated $900 million. Tom Ricketts is the chief executive of Chicago investment bank InCapital LLC. Another offer has been submitted by Marc Utay, managing partner with the New York-based private equity firm Clarion Capital Partners LLC, although his offer is believed to be more risky.

If Tribune decides to file for bankruptcy on behalf of the Cubs, it would be the first Major League Baseball team in 40 years to file for bankruptcy.

Representatives from the Tribune Co. and Major League Baseball would not comment on the deal.
