St. Petersburg Man Faces Federal Charges for Bankruptcy Fraud

By Leavengood, Dauval & Boyle, P.A.  Sep. 6, 2011 3:50p

A St. Petersburg man recently pled guilty to bankruptcy fraud before federal court. The man, J.H., had filed for bankruptcy protection in early 2009. He failed to fully disclose all income and investments in his petition and did so again at the meeting of the creditors as the bankruptcy process proceeded. He had invested about $35,000 in a foreign currency (or "forex") trading venture and was receiving interest monthly. Additionally, he began receiving a monthly salary from the company of $10,000 plus commissions when he became an authorized representative for the forex. It was found that J.H. and the shell company he created had received nearly $1.5 million from the venture. This income was received before and after he had filed for bankruptcy and he admitted to knowingly failing to report the investments and income. The Florida man could receive up to five years in federal prison for bankruptcy fraud.
